Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and morphcam. They cover the morphcam app and website, the morphs you create, and any subscriptions or purchases. Please read them — by using morphcam, you agree to them. If you don’t agree, don’t use the service.
The one rule that matters most: only morph people who have agreed to it. Don’t use morphcam to impersonate, deceive, harass, or create sexual or harmful content about real people. Accounts that do are removed.
1. Who we are
morphcam is operated by an independent sole operator based in Costa Rica (“morphcam”, “we”, “us”, “our”). You can reach us at hello@morphcam.com.
2. Eligibility
You must be at least 13 years old to use morphcam. If you are under the age of majority where you live, you may only use morphcam with the permission and supervision of a parent or legal guardian who agrees to these Terms on your behalf. You must be 18 or older (or have your parent or guardian complete the purchase) to buy a subscription or credits. By using morphcam, you confirm you meet these requirements.
3. What morphcam does
morphcam takes a short video you record and uses generative AI to transform the person in it into one of our characters — the result is a new, AI-generated video. Outputs are creative transformations, not real footage, and may be imperfect or unexpected. We may change, add, or remove characters and features over time.
4. Your account
You can use morphcam anonymously or create an account. You are responsible for activity under your account and for keeping your credentials secure. Don’t share your account, create accounts by automated means, or try to evade limits such as the one-free-morph allowance. Tell us promptly if you suspect unauthorized use.
5. Your content and the consent rule
“Your Content” means the videos, images, and audio you upload. You keep all the rights you already have in Your Content. We do not claim ownership of it.
You grant us a limited, worldwide, royalty-free license to host, store, process, transform, and transmit Your Content solely to operate the service and create your morph — including sending it to our AI processors. This license ends when your content is deleted, except for copies retained briefly in backups or as required by law. We do not use Your Content to train AI models and we do not sell it.
You represent and promise that:
- you own or have the rights to Your Content and to everyone appearing in it;
- every identifiable person in your video has given you their consent to be filmed and morphed; and
- Your Content does not infringe anyone’s rights or break any law.
You are responsible for the morphs you create and share. The result is AI-generated; if you publish or distribute it, do so honestly and don’t present it as real.
6. Acceptable use
You agree not to use morphcam to create, upload, or share content that:
- depicts a real person without their consent, or impersonates someone to deceive, defraud, or defame;
- is sexual, especially any sexual content involving minors, or that sexualizes a real person without consent;
- harasses, bullies, threatens, or promotes hatred or violence against anyone;
- is misleading in a way meant to cause harm — for example fake “evidence”, election or public-safety disinformation, or scams;
- infringes intellectual-property, privacy, or publicity rights; or
- is otherwise illegal or violates these Terms.
You also agree not to reverse-engineer, scrape, overload, or interfere with the service, or attempt to access it in unauthorized ways. We may screen content for safety and may remove content or suspend or terminate accounts that break these rules.
7. Free morphs, credits, and pool-seconds
morphcam includes a one-time free morph and paid plans that grant a balance of render time (“pool-seconds” or credits). Credits and plan allowances have no cash value, are not transferable or redeemable for money, and may expire as described at the point of purchase. We may adjust pricing, allowances, and the way renders are metered; changes apply going forward.
8. Subscriptions and billing
morphcam offers auto-renewable subscriptions and one-time credit purchases sold as in-app purchases through the Apple App Store and Google Play and managed via RevenueCat. The following terms apply to auto-renewable subscriptions:
- What you get and the price are shown in the app before you buy. Prices may vary by region and may change; any change is shown before it takes effect.
- Payment is charged to your Apple ID or Google account at confirmation of purchase.
- Auto-renewal: your subscription automatically renews for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Managing and cancelling: you can manage or cancel your subscription, or turn off auto-renewal, in your Apple App Store or Google Play account settings after purchase. Cancelling stops the next renewal; it does not retroactively refund the current period.
- Free trials (if offered): any unused portion of a free trial is forfeited when you buy a subscription, where applicable.
Refunds for App Store and Google Play purchases are handled by Apple and Google under their policies, not by us. Except where the law or the relevant store requires, payments are non-refundable.
9. Intellectual property
The morphcam name, logo, the characters in the Cast, the app, the website, and their software and design are owned by morphcam or its licensors and are protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use morphcam for your own non-commercial enjoyment, subject to these Terms. You may share morphs you create on social platforms; you may not resell the service or use our characters or branding to imply endorsement.
10. Third-party services and stores
Your use of morphcam through the Apple App Store or Google Play is also subject to those stores’ terms. Where required, you acknowledge that the app stores are not responsible for morphcam, that this agreement is between you and us (not the store), and — for iOS — that Apple and its subsidiaries are third-party beneficiaries entitled to enforce these Terms against you.
11. Disclaimers
morphcam is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that morphs will meet your expectations. Generative AI can produce unexpected, inaccurate, or unrealistic results; you use it at your own discretion.
12. Limitation of liability
To the fullest extent permitted by law, morphcam will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the service. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the 12 months before the claim or US$50. Some jurisdictions don’t allow certain limitations, so some of these may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless morphcam from any claims, damages, and expenses (including reasonable legal fees) arising out of Your Content, your use of the service, your violation of these Terms, or your violation of anyone’s rights — including any claim that you morphed a person without their consent.
14. Suspension and termination
You may stop using morphcam at any time and request account deletion via hello@morphcam.com. We may suspend or terminate your access if you breach these Terms, to protect the service or other users, or as required by law. Sections that by their nature should survive termination (such as content licenses already granted, disclaimers, liability limits, and indemnity) will survive.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of Costa Rica, without regard to its conflict-of-laws rules. The courts of Costa Rica will have jurisdiction over any dispute, except where mandatory consumer- protection laws of your country of residence give you the right to bring proceedings locally. Nothing in these Terms removes consumer rights that cannot be waived under the law that applies to you.
16. Changes to these Terms
We may update these Terms as morphcam evolves. When we make material changes, we will update the “last updated” date and, where appropriate, notify you in the app. Continuing to use morphcam after a change means you accept the updated Terms.
